Frequently Asked Questions

Why should I hire an Attorney?

The legal system can be intimidating and overwhelming for anyone. We're here to help find the answers and reach your criminal defense goals. Some things are outside our control - but we will help you understand your options so you can keep your record clean.

Our goal is to make your life easier by standing between you and the uncertainties of dealing directly with the long lines and complicated procedures of the court on your own without representation.

Many cases can be resolved without a trial and even without you needing to make a personal appearance at the court or our offices – meaning you can stay at work or in school while we appear on your behalf to resolve the matter and keep your driving record clean. Most questions can be addressed online or over the phone, whichever is most convenient for you, and of course, you may stop by anytime in person without an appointment to visit face-to-face.

Will I still have to appear at the court?

In most cases Mallory, Lollar, Holt & Associates, P.C. Attorneys can appear on your behalf at the court to resolve your legal matter.

Some case types will require your personal appearance – for instance, allegations involving Assault, Tobacco, Alcohol, Drug Paraphernalia or any case that has been in Warrant Status may trigger a requirement by the Judge of the court for you to make a personal appearance even if you have an Attorney.

Let us know what type of case you have, and we can quickly answer the question of whether you need to plan to appear with the Attorney in court.

I hold a Commercial Driver License (CDL), what can you do for me?

In most cases Mallory, Lollar, Holt & Associates, P.C. Attorneys can appear on your behalf at the court to resolve your legal matter without you needing to miss any work.

Commercial Driver License (CDL) Holders are under different State and Federal rules for how a Traffic Ticket or other Class C Misdemeanor allegations may be resolved, but that does not mean you have no options available.

We are willing to bring the fight to protect your livelihood – up to and including trial for NO ADDITIONAL FEE.

Will I still have to pay my Ticket?

There are several disposition options available to resolve your case.

Mallory, Lollar, Holt & Associates, P.C. Attorneys will work diligently to find a dismissal option with the lowest possible out-of-pocket expense for you. If your case is dismissed outright, you pay nothing other than the representation fee – which includes a trial.

If you choose to accept a dismissal option by plea bargain on your case, such agreements can be thought of like a contract to dismiss. Like most contracts, a fee and compliance with conditions could be required.

Generally, the fee is lower than you could achieve on your own with the court, and the additional terms are reduced to the minimum permissible by law to reduce the overall burden for you to comply with the agreement and achieve the dismissal. We will guide you start to finish through the entire process, with you every step of the way to ensure your success.

Can you guarantee my case will be dismissed?

No.

Mallory, Lollar, Holt & Associates, P.C. Attorneys will work diligently to find reasons why the State cannot move forward to trial on your case, which could lead to an outright dismissal – but the types of flaws leading to outright dismissal are very rare.

Our Attorneys are experienced Trial Lawyers and will take your case to the jury if you would like, but we cannot guarantee an outcome.

We do guarantee to stand beside you and fight to protect you rights.
